Purpose of research: Applied research
As part of the research assignment following facts are scientifically studied: presentation of the current legal situation in Germany regarding the protection of personal data in consumer contracts, particularly with regard to the use of debit cards (loyalty schemes) and the use of RFID technology (Radio Frequency Identification). A distinction should be after the collection, processing and use of personal data for the purpose of fulfilling a contractual relationship and the collection, processing and use for other, more extensive use (eg the creation of customer profiles, etc.). What is the significance in this context, the consent of the individual (consumer) as the legal basis for the collection, processing and use of personal data by the company? What information duties towards consumers exist for companies with respect to the collection, processing and use of personal data of consumers? What information and other rights available to consumers as part of the collection, processing and use of their personal data? To what extent consumers are aware their rights? To what extent these rights are perceived by consumers? Investigation of the applicable data protection laws with regard to possible shortcomings of an effective consumer protection. In what ways can these gaps? Investigation as to whether and if so, which government deficits in the monitoring of compliance with applicable data protection laws. What measures can be taken to provide more transparency for consumers and information on the collection, processing and use of their personal data by the company? In what ways can the commitments made by the company or conduct voluntary certification (data protection audits) to improve compliance and contribute to the protection of privacy rights of consumers?
