1. Ambitions of the project
The project shall offer an assistance proposal to the federal ministry of food, agriculture and consumer protection to support decisions about optional adaptations of the German Emergency Food Preparedness Act (EVG). Furthermore suited drafts of executive order laws have to be developed to ensure effective reactions to a nationwide crisis of food supply. These legal instruments shall be part of optimizing the legal handling of such a scenario.
2. Methods of work
At first, the EVG itself has to be analyzed regarding to the current deficiency which were discovered especially at the LÜKEX in the past years. On the one hand the project will question the legal preconditions of the application of the EVG to suit it better to the numerous other laws according to a scenario committing a catastrophe in Germany. On the other hand an orientation towards specific ambitions of protection may be established in the law to strengthen the administrative crisis management.
At second, concepts of executive order laws shall be prepared on which the agencies are able to act efficiently. These executive order laws are in practise the more important legal instruments than the EVG because only they contain the precise procedures and permissions specifying the EVG. Comparisons and distinctions to other similar executive order laws according to food crisis management will support the development of adequate solutions.
3. Task schedule
The first part is referred to the work on the EVG and will endure to the first half of 2012 (three quarters). The work on the drafts of the executive order laws will take the remaining five quarters. During the first and the second part (in each case after finishing initial work) as well as at the change between the two parts there will be a milestone to enable the ministry to direct the project.
